DATA USE POLICY
Effective: July 21, 2025
This Datalab Data Use Policy (the “Policy”) published by Endless Labs, Inc. DBA Datalab (“Datalab”) sets forth Datalab’s use rights with respect to data submitted to Datalab’s products or services or otherwise made available to Datalab in connection with the use of Datalab’s products and services (“Data”). To the extent this Policy is referenced in the Datalab Terms of Service (“ToS”) [make hyperlink], or in the corresponding commercial agreement (“CA”) between Datalab and the entity or person specified as the customer therein (“Customer”), the additional Data use rights set forth in this Policy shall supplement and are in addition to the data use rights in the ToS and the CA. Notwithstanding anything to the contrary in the ToS, the applicable CA, any exhibits, addenda, agreements or policies referenced therein (other than this Policy), Customer acknowledges and agrees to the Data use rights set forth herein.
The applicable Data use rights shall apply with respect to the particular use case as set forth below.
- Data Use Rights.
- Data used to train Datalab models (“Training Data”). Training Data includes, but is not limited to output resulting from Customer’s use of Datalab products and services; inputs and requests submitted to Datalab products and services; and information and Data regarding files uploaded into Datalab products and services. Datalab may freely use Training Data for any purpose including but not limited to training and improving Datalab models and Datalab products and services.
- Data used for internal purposes, such as but not limited to testing and quality assurance (“Internal Use Data”). Internal Use Data includes, but is not limited to Data regarding the performance and operation of Datalab products and services. Datalab may freely use Internal Use Data to improve the performance and operation of Datalab products and services.
- Data used to make improvements to Datalab products and services, such as but not limited to new features and functions (“Improvement Data”). Improvement Data includes, but is not limited to Data related to Customer’s use of Datalab products and services. Datalab may freely use Improvement Data to make improvements to and add new features and functions to Datalab products and services.
- Customer may opt out of Datalab’s use of Training Data and Internal Use Data by indicating the same in the Datalab dashboard located at the following URL: https://www.datalab.to/app/dashboard after which Datalab will cease use of the same.
Datalab may update this Policy from time-to-time by publishing such update and providing notice to Customer pursuant to the ToS or CA, as applicable. The updated Policy shall apply following such notice.
